RENTAL USAGE AGREEMENT

This Rental Usage and Liability Agreement (the "Agreement") is made by and between Caibrate Estates LLC ("The Company") and Guest who Accepted Terms ("Guest") as of the date last set forth on the signature page of this Agreement. For good and valuable consideration, the sufficiency of which is acknowledged, the parties agree as follows:

  1. Rental Unit, Ownership, and License

  2. 1.1 Rental Unit

  3. The rental unit is located at: {{listing_street}} (the "Rental Unit").

1.2 Ownership

The Rental Unit is privately owned by an independent third-party (the "Owner") for which The Company is acting as an agent. Properties are privately owned by independent owners, and Calibrate Estates acts as management/agent on their behalf.

1.3 License Only

Guests receive a limited, revocable license to occupy the Rental Unit for temporary vacation use only. This is not a lease and does not create a tenancy or any other property interest.

Rental Party, Maximum Occupancy, and Use

2.1 Rental Party

  1. The rental party shall consist of Guest and the following persons: {{guest_full_name}} (the "Rental Party"). Members of the Rental Party are the sole responsibility of the Guest. The “Rental Party” includes the primary guest and all persons listed on the reservation.

2.2 Maximum Occupancy

The maximum number of guests in the Rental Unit is limited to {{listing_max_occupancy}} persons. I agree that unauthorized guests of mine invited to the premises beyond the maximum occupancy as indicated on your reservation details shall be charged 50 dollars per person per day. This includes both visitors and overnight guests. If you invite additional visitors, please let us know the reason and duration of the visit. Unauthorized guests (including visitors and overnight guests beyond the stated occupancy) may result in termination of the stay without refund.

2.3 Permitted Use

The Guest agrees to use the Rental Unit only for the purpose for which it is rented herein and in accordance with this Agreement. The Guest shall not permit any use of the Rental Unit which is inconsistent with or contrary to this Agreement or applicable laws, rules, and/or regulations ("Applicable Laws"). No business may be conducted from the Rental Unit. Properties may be used only for residential vacation purposes by the registered Rental Party. Business activities, commercial use, or events are prohibited without prior written approval from Calibrate Estates.

Term of the Agreement, Check-In, Check-Out, and Access

3.1 Term of the Agreement

  1. The rental period begins at {{check_in_time}} on {{check_in_date}} (the "Check-in Date") and ends at {{check_out_time}} ("Checkout Time") on {{check_out_date}} (the "Checkout Date") (collectively, the "Rental Period").

3.2 Check-In / Check-Out Times

Standard check-in time is 4:00 p.m. or later on the scheduled arrival date. Standard check-out time is 10:00 a.m. or earlier on the scheduled departure date. Early check-in and late check-out may be offered at The Company’s discretion and may incur additional fees.

3.3 Late Departure / Holdover

Guests who stay beyond the scheduled check-out time or delay housekeeping or maintenance may be charged starting at 55 dollars per hour (pro-rated) after 11:30 a.m. Continued holdover may result in removal, additional charges, and liability for any resulting costs.

3.4 Access for Management

Guest shall allow The Company access to the Rental Unit for purposes of repair and inspection. The Company, the property owner, and their agents may enter the property at reasonable times for inspection, maintenance, repair, or to resolve issues and rule violations. In case of emergency or suspected violation of law or this Agreement, entry may occur at any time.

3.5 Pre-Check-In Requirements / Minimum Age

Guests may be required to: electronically accept this Agreement and any supplemental house rules; provide a valid government-issued photo ID; and complete a pre-arrival or verification form. Refusing to comply with these measures does not make your reservation eligible for a refund and may result in cancellation of the stay without refund.

The primary guest must typically be at least 25 years of age (or a higher age if required for a specific property or community). A readable copy of a valid driver’s license or ID may be required prior to arrival.

Reservation, Payments, Security Deposit, and Cancellation

4.1 Reservation and Payments

  1. Rental Rate: Payment in full of the posted fees shall be due upon booking. An initial payment is applied toward the total cost of the reservation as specified at booking. All major credit cards may be accepted for payments; additional payment methods may be provided at the time of booking. If check or other offline payment methods are allowed, instructions will be provided during the booking process; such methods may not be accepted within 30 days of arrival.

4.2 Security Deposit / Authorization Hold

Security Deposit: A 250–750 dollar security deposit in the form of an authorization hold is required. Where applicable, such deposit is for security purposes and shall be refunded within 7 days of the Checkout Date provided no deductions are made due to: damage to the Rental Unit or contents thereof; debris or other mess requiring excessive cleaning; any fines, HOA penalties, or other costs caused by the Guest, their party, or visitors; or any other cost incurred by The Company as a result of the Guest’s stay.

4.3 Damage Waiver (If Offered)

If a separate damage waiver fee is charged, it may waive the Guest’s financial responsibility for unintentional damage up to a stated limit per stay (for example, up to 3,000 dollars), as described at booking. Damage exceeding that limit, or excluded from waiver coverage (for example, intentional or negligent damage), remains the Guest’s responsibility. Guests must promptly report any damage for coverage to apply.

4.4 Cancellation Policy

Cancellation Policy. Please refer to the cancellation policy you agreed to when booking on your online travel agency. Cancellations are governed by the cancellation policy displayed at the time of booking on the applicable booking channel, which controls the timing and amount of any refund, administrative fee, or forfeiture of payments.

Cleanliness, Maintenance, and Furnishings

5.1 Cleaning and Condition

  1. Properties are professionally cleaned and inspected before and after each stay. Guests are responsible for maintaining the property in a clean, orderly, safe, and sanitary condition during their stay, free of trash, junk, pet excrement, refuse, nuisances, or conditions that threaten health or safety, and in a manner which is aesthetically pleasing. If cleanliness or condition is unsatisfactory upon arrival, guests must promptly notify The Company so concerns can be addressed.

5.2 Guest Responsibilities

Guests must: properly bag and dispose of trash according to property-specific instructions; avoid creating unsanitary conditions or excessive trash; and use appliances, systems, and amenities as intended. Failure to maintain reasonable cleanliness may incur additional cleaning fees starting at 150 dollars or more. Maintain the property in a clean and orderly condition; excessive mess is a 150 dollar cleaning fee.

5.3 Damage and Reporting

Guests must promptly report any damage, malfunction, or safety concern at the property. Failure to report may increase liability, void damage-waiver coverage, and result in additional charges, including full deduction from the security deposit. Guests must report any property damage to customer service; unreported damages will be deducted from the security deposit or charged via other means.

5.4 Furniture and Layout

Guests may not move heavy furniture, disconnect electronics, or alter the layout without prior approval. Unauthorized furniture rearrangement may result in a 100 dollar fine plus any repair costs. Do not move furniture without approval; unauthorized rearrangement = 100 dollar fine.

5.5 Furniture and Bunk Beds – Assumption of Risk

I specifically accept all liability for use of furniture including bunk beds on the property and understand that The Company shall have no liability for any accidents, injuries, or death that may result from the proper or improper use of furniture or bunk beds. Guest accepts said liability by the voluntary use of said bunk beds. Guests accept all liability for the use of furniture, including bunk beds and elevated sleeping areas.

5.6 Child Safety

Properties are not childproof. Parents, guardians, and responsible adults must supervise children at all times.

Noise, Conduct, Smoking, and Community Rules

6.1 Quiet Hours and Noise

  1. Quiet Hours are 9:00 p.m. – 7:00 a.m. Quiet hours generally run from 9:00 p.m. to 7:00 a.m., or as specified by the applicable community or township. HOA noise violations or complaints result in a 500 dollar fine. Unreasonable noise or disturbances that bother neighbors or violate local regulations may result in fines starting at 500 dollars, revocation of the occupancy license, and eviction without refund.

6.2 Parties, Events, and Gatherings

No parties, gatherings, or events are allowed; violations may result in a 5000.00 dollar fine, additional damage charges, and possible or immediate eviction. Overnight guests that exceed the number stated in the reservation are prohibited.

6.3 Smoking and Vaping

All properties are non-smoking indoors. No smoking or vaping inside or within 25 feet of the home (or as otherwise posted) is permitted. Evidence of smoking or vaping may result in cleaning and deodorizing fees starting at 500 dollars and up to 1,000 dollars, plus any additional damage. Violations are subject to a 500 dollar fine per violation.

6.4 Monitoring and Tampering

Certain properties may use noise or smoke-detection technology (non-recording) to monitor excessive noise or potential policy violations. Noise and smoking detecting technology is used inside suites to monitor excessive noise levels and violations of the non-smoking policy. Tampering with or disabling any such devices is prohibited and may result in fines beginning at 250 dollars.

6.5 Fireworks and Hazardous Items

Fireworks of any kind, including sparklers, are strictly prohibited; violation results in up to a 1,000 dollar fine and immediate eviction. Dangerous or hazardous items (for example, candles, open-flame devices, or items that may increase the risk of fire or explosion) are not allowed unless explicitly authorized.

6.6 Illegal Activity and Weapons

No illegal activity, pornography production, or prostitution is permitted on the premises. Illegal activities, including illegal drug use, prostitution, or production of pornography, are strictly prohibited. Firearms and weapons are prohibited except as lawfully possessed by on-duty or off-duty law enforcement or licensed security personnel. Violations may result in a 500 dollar fine, eviction, and notification of authorities.

6.7 Community / HOA Rules

Guests must abide by all HOA, condominium, and community regulations applicable to the property. HOA and community rules must be followed; violations may result in 250–1,000 dollar fines per infraction. Fines imposed by HOAs or local authorities due to guest conduct will be charged to the guest and may range from 250 to 1,000 dollars per incident.

Outdoor Areas, Parking, Snow, and Fires

7.1 Parking

  1. Parking is limited to designated spaces or driveways associated with the property. Parking on roads or shoulders may be prohibited by community or local rules. Parking is limited to approved vehicles only; unregistered or improperly parked vehicles may be subject to fines of 100 dollars per day and towing at the guest’s expense. No RVs, trailers, boats, or street parking without written approval; recreational vehicles, trailers, and boats may be prohibited unless prior written approval is obtained.

7.2 Snow and Ice

  1. Driveway snow plowing may be provided after a specified accumulation (for example, after 4 inches), depending on the property and only after notification from the management company. Plowing of the driveway by the management company does not include shoveling or treatment of any walkways, stairs, decks, or entry areas. The Guest and all members of their party are solely responsible for clearing and treating snow and ice on all walkways, stairs, decks, and entry areas during their stay and for keeping these areas safe for use. Surfaces may be extremely slippery when wet or icy, and the Guest and their party expressly assume all risk of slips, falls, injuries, or other losses arising from snow, ice, or slippery conditions anywhere on or around the property, and release the Owner, Management Company, and their agents from all liability related to such conditions to the fullest extent permitted by law.

7.3 Outdoor Fires and Grills

  1. Outdoor fires are only permitted where explicitly allowed by the specific property and community. Guests must follow all posted rules for fire pits, fireplaces, and grills and must never leave them unattended. Do not leave grills or fire pits unattended; guests accept full responsibility and liability for any damage or loss caused by misuse of fire pits, grills, or outdoor fires.

Pets, Service Animals, and Wildlife

8.1 Pet Policy

  1. Pet eligibility, limits, and fees vary by property and are clearly stated in the listing. Pets require pre-approval and registration; pre-stay registration is required, including pet type, size, and breed. Pet Policy: 25 dollars per night, maximum 250 dollars per month; up to two pets per unit unless arrangements are made in advance.

8.2 Pet Fees and Liability

Pet fees may be charged per pet per night and/or per stay, subject to any published caps. Guests are responsible for all pet-related damage, extra cleaning, odor removal, pest treatment, and any HOA or community fines triggered by pet behavior. Guests are liable for any pet-related damage or extra cleaning costs.

8.3 Unauthorized Pets

Bringing unapproved or unregistered pets may result in a minimum fine of 250 dollars or a deep-clean fee where required, plus additional damage and cleaning charges. Unregistered pets = 250 dollar fine.

8.4 Service Animals

Legitimate service animals are permitted where required by law; advance notice is requested. Service Animals may stay at no extra charge, but please inform us before arrival. Documentation or permitted verification may be requested consistent with applicable regulations.

8.5 Wildlife

Guests must not feed, approach, or harass wildlife. Guests assume all risk for any injury, damage, or consequences related to wildlife interactions or violations of this rule. Do not feed or approach wild animals; Guest assumes risk for violations.

Pools, Hot Tubs, Amenities, and Common Areas

9.1 Use at Own Risk​

Use of any pools, hot tubs, saunas, decks, fitness rooms, recreational equipment, and similar amenities (indoor or outdoor) is strictly voluntary and entirely at the risk of Guest, members of the Rental Party, and all visitors. Surfaces may be wet or slippery, water and heat features involve inherent hazards, and no lifeguard or attendant is provided; by using these areas, Guest acknowledges and assumes all risk of injury, illness, or death to themselves and others in their party. Guest is solely responsible for supervising children and any individuals requiring assistance in and around these areas. Misuse, contamination (including but not limited to bodily fluids, foreign objects, glass, food, or excessive debris), or failure to follow posted instructions or capacity limits may result in additional cleaning or service fees typically ranging from 25 to 250 dollars or more, charged to Guest’s payment method on file.​

9.2 Rules of Use and Fees​

No glass, breakable containers, or similar items are permitted in or around any pool, hot tub, sauna, deck, or other wet area; any violation may result in a 250 dollar fine per incident, plus all related damage, draining, cleaning, and service costs. Guest agrees to use all amenities only in accordance with posted rules, manufacturer guidelines, and any instructions provided by The Company, Calibrate Estates, or the property owner, including but not limited to maximum occupancy, temperature limits, showering before use, and required cover use and closure. Misuse, negligent operation, contamination, or damage to pools, hot tubs, saunas, decks, furnishings, or related equipment may result in additional service, repair, replacement, or downtime fees, commonly between 25 and 250 dollars or more depending on the nature and extent of the issue, which Guest authorizes The Company to charge to the payment method on file and/or deduct from any security deposit. Surfaces in and around pools, hot tubs, and decks may be wet, uneven, or icy and can be hazardous; Guest accepts all risks of slips, trips, falls, and related injuries, and agrees to hold The Company, Calibrate Estates, the property owner, and their affiliates harmless from any claims or liability arising out of such use except to the extent prohibited by applicable law.​

9.3 Common Areas and Surveillance​

Common and shared areas of the building or community (including, without limitation, lobbies, hallways, stairwells, elevators, parking areas, mail rooms, and amenity spaces) may be subject to video or other security monitoring for safety, security, and rule-enforcement purposes, and Guest consents on behalf of themselves, the Rental Party, and their visitors to such monitoring in these non-private areas to the fullest extent permitted by law. Guest must use common areas solely for their intended purpose and must not loiter, solicit, block access, create excessive noise, or engage in any disruptive, unsafe, or illegal conduct. Any violation of building, HOA, or community rules or any damage, nuisance, or misconduct in common areas may result in fines, fees, eviction, or other remedies as described in this Agreement and in the applicable community regulations, all of which Guest agrees may be charged to the payment method on file and/or deducted from any security deposit.

Mail, Packages, and Personal Property

10.1 Mail and Deliveries

  • No Mail or Package Deliveries. Guests are not permitted to have mail or packages delivered to the property. Properties do not accept personal mail or package deliveries for guests unless explicitly stated. Items shipped to the property may be refused, returned, or lost; neither The Company, Calibrate Estates, nor the property owner is responsible for such items. Use local postal services, lockers, or package holding facilities for your delivery needs; any deliveries to the property will be declined or returned to sender, and we are not liable for lost or returned items.

10.2 Lost and Left-Behind Items

The Company, Calibrate Estates, and Owners are not responsible for personal items lost, stolen, or left behind at the property. Retrieval of left items, if possible, may incur handling and shipping fees.

Insurance, Risk, and Indemnification

11.1 Guest Insurance

The Guest expressly recognizes that any insurance for property damage or loss that may be maintained on the Rental Unit does not cover the personal property of the Guest and that the Guest is responsible for purchasing their own insurance if such coverage is desired. Insurance carried on the property generally does not cover guests’ personal property. Guests are encouraged to purchase travel insurance and/or renters’ insurance to cover trip interruptions, cancellations, and personal belongings.

11.2 Assumption of Risk

Guests acknowledge that use of the property and any amenities involves risks, including personal injury, property damage, illness, and death. By occupying the property, guests voluntarily assume all such risks for themselves, their party, and their visitors. I am fully aware of hazards connected with being on the premises, and I am fully aware that there may be risks and hazards unknown to me connected with being on the premises, and I hereby elect to voluntarily be on and upon, to enter upon the above-named premises and engage in activities knowing that conditions may be hazardous or may become hazardous or dangerous to me and my property. I voluntarily assume full responsibility for any risks of loss, property damage, or personal injury, including death, that may be sustained by me, or any loss or damage to property owned by me, as a result of my being on the premises, whether caused by the negligence of releasees or otherwise.

11.3 Indemnification

Guest shall indemnify and hold harmless The Company, Calibrate Estates, the Owner, and any of their affiliates, employees, agents, representatives, subcontractors, successors, or assigns from and against any liabilities or any loss or damage whatsoever arising from, related to, or in connection with the Guest’s use of the Rental Unit and/or common areas, including but not limited to any claim for personal injury or damage or loss of property made, incurred, or sustained by the Guest, Rental Party, or any Visitors to the Rental Unit during the Rental Period. Guests agree to indemnify and hold harmless Calibrate Estates, property owners, and their affiliates, employees, agents, and contractors from any claims, damages, losses, or expenses arising out of use or occupancy of the property or common areas, violation of these Terms or community rules, or violation of law or regulations by the guest, their party, or visitors.

11.4 Service Interruptions and Acts of God

The Company, Calibrate Estates, and property owners are not liable for interruptions or failures of utilities or services, or for events beyond their control (including severe weather, natural disasters, or actions of public authorities). Inability to travel to or occupy the property due to such events may not entitle guests to refunds beyond what is provided in the applicable cancellation policy.

Violations, Remedies, and Costs

12.1 Policy Violations and Remedies

  1. Violation of any provision in this Agreement, the Rental Rules, property-specific house rules, or community regulations may result in: fines; deduction from the security deposit or charges to the payment method on file; termination of the stay and revocation of the license to occupy; and eviction without refund. Violation of any rule may result in fines, deductions from the deposit, or termination of stay without refund. Guests who violate these rules are liable for any associated damages, fees, costs, or expenses and are not eligible for refunds and may be subject to immediate cancelation and eviction.

12.2 Costs, Fines, and Fees

Guests are responsible for payment of all: cleaning fees caused by misuse or neglect; damage repairs and replacement costs; HOA or municipal fines triggered by guest conduct; and collection costs, including reasonable attorney’s fees, associated with enforcing this Agreement.

Governing Law, Dispute Resolution, and Venue

13.1 Governing Law

  • This Agreement shall be governed by and interpreted in accordance with local laws of {{listing_city}}. These Terms and Conditions are governed by the laws of the state and local jurisdiction in which the property is located.

13.2 Dispute Resolution

In the event of a dispute, The Company encourages informal resolution with guests. If unresolved, disputes may be submitted to mediation or other agreed forms of alternative dispute resolution before litigation, where permitted by law.

13.3 Venue

Any legal action, where required, shall be brought in a court of competent jurisdiction in the county where the property is located, unless applicable law provides otherwise.

  1. Travel Insurance

  2. By my signature below, I hereby confirm that I have read my rights to purchase travel insurance. Guests are encouraged to purchase travel insurance and/or renters’ insurance to cover trip interruptions, cancellations, and personal belongings.

Exhibit A: RENTAL RULES

Throughout the Rental Period, the Guest shall, and shall ensure that the Rental Party and any Visitors to the Rental Unit shall abide by the following rules:

1 Security Deposit and Pre-Check-In

  • Reservations require a 250–750 dollar security deposit in the form of an authorization hold. Prior to check-in, we will send you a link to a payment portal to collect this hold. If you booked on Airbnb, you can find more information about this policy in the Airbnb help article titled “What is the Airbnb policy for collecting fees outside of Airbnb?”

  • As per the building rules we operate, we require you to e-sign this Agreement/waiver before checking in.

  • Regulations require us to request a photo submission of your ID before you can check in.

  • We will send you a pre-check-in link to satisfy these requirements. Refusing to comply with these measures does not make your reservation eligible for a refund.

2 Check-In and Check-Out

  • Check-in is at or after 4:00 p.m. on your Check-in Date.

  • Checkout is at or before 10:00 a.m. on your Checkout Date.

  • Early check-ins and late checkouts may be available upon request and are subject to additional fees.

  • Guests who stay beyond their designated checkout time or delay housekeeping staff are liable for associated costs and expenses, starting at 100 dollars per hour (pro-rated) after 10:30 a.m.

3 Prohibited Conduct

  • The following is strictly prohibited during your stay:

  • Smoking, parties, and excessive noise, including on balconies and in shared spaces.

  • Noise and smoking detecting technology is used inside the suites to monitor excessive noise levels and violations of the non-smoking policy. Tampering with any of these devices is a direct violation of house rules and subject to fines starting at 250 dollars for each occurrence to clean, deodorize, and repair damages.

  • Dangerous or hazardous items (for example, candles, lighters, fireworks, open flames, or explosive items).

  • Fireworks of any kind, including sparklers; violations may result in up to a 1,000 dollar fine and immediate eviction.

  • Firearms and other weapons (except those rightfully possessed by on-duty or off-duty law enforcement officials or licensed security guards).

  • Commercial photography/videography without written consent.

  • Illegal activity, pornography production, or prostitution.

  • Overnight guests that exceed the number stated in the reservation.

  • Making any change, modification, alteration, or addition whatsoever to the unit or its contents (including moving furniture around).

  • Soliciting or loitering around the space or building.

  • Creating unsanitary conditions (for example, generating excessive trash, offensive odors, or attracting pests).

  • Only members of the Rental Party are permitted to stay overnight in the Rental Unit. Anyone else the Guest allows in the Rental Unit (a "Visitor") is the sole responsibility of the Guest and is strictly forbidden unless approved by The Company.

Pets

  • Pet Policy: Listed on Booking Engine Used.

  • Up to two pets per unit unless arrangements are made in advance and Booking engine says otherwise.

  • Pre-stay registration required; include pet type, size, and breed.

  • Pets must be controlled and on a leash or in a carrier in public areas.

  • Guests are liable for any pet-related damage or extra cleaning/odor/pest treatment and any HOA or community fines triggered by pet behavior.

  • Unregistered or unapproved pets may result in a minimum 250 dollar fine or deep-clean fee plus additional damage and cleaning charges.

Safety, Health, and Common Areas

  • For your and our staff’s safety, masks are encouraged in any public area, including but not limited to the lobby, elevators, and hallways.

  • Public and common areas such as hallways, parking, and the lobby operate video surveillance devices for safety and security.

  • Guests are responsible for covering the cost of replacing lost keys, key cards, fobs, or parking passes.

Mail and Deliveries

  • Guests are not permitted to have mail or packages delivered to the property.

  • Use local postal services or package holding facilities for your delivery needs.

  • Any deliveries to the property will be declined or returned to the sender; we are not liable for any lost or returned items.

Additional House Rules and Enforcement

  1. Guests who violate these rules are liable for any associated damages, fees, costs, or expenses. Violators of the House Rules are not eligible for any refunds and may be subject to immediate cancelation and eviction.

Signature and Acknowledgment

THE PARTIES AGREE TO THE TERMS OF THIS SHORT TERM RENTAL AGREEMENT, AS EVIDENCED BY THE SIGNATURES SET FORTH BELOW DATED (Accepted Date).

In signing this Release, I acknowledge and represent that:

  • I have read the foregoing Agreement and release, understand it, and sign it voluntarily as my own free act and deed;

  • No oral representations, statements, or inducements, apart from the foregoing written Agreement, have been made;

  • I am at least eighteen (18) years of age and fully competent; if I am under eighteen (18) years of age, my parent or guardian may sign this document adding my name to the document;

  • I execute this Release for full, adequate, and complete consideration, intending to be bound by the same.
